About Our Privacy Policy

Online otaku B.V. cares deeply about your privacy. We therefore only process data that we need for (improving) our services and handle with care the information we have collected about you and your use of our services. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services made available on it by Online Otaku B.V. The effective date of these terms is 22/12/2021; with the publication of a new version, all previous versions become invalid. This privacy policy describes what data we collect about you, how this data is used, and with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect it against misuse, and what rights you have regarding the personal data you provide to us.

Webshop Software

Online Otaku

Our webshop is fully self-developed. Personal data that you provide to us for the purpose of our services is therefore not shared with any website builder and remains entirely within our own system. Under the agreement, we are obliged to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy.

Web Hosting

We use web hosting services from Digital Ocean. Digital Ocean processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. These are not personal data. Digital Ocean has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Under the agreement, Digital Ocean is obliged to maintain confidentiality.

For our regular business email traffic, we use the services of Versio. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. They have no access to our mailbox, and we treat all our email communication confidentially.

Payment Processors

MultiSafepay

For processing payments in our webshop, we use the MultiSafepay platform. MultiSafepay processes your name, address, and residence details, as well as your payment information such as your bank account or credit card number. MultiSafepay has taken appropriate technical and organizational measures to protect your personal data. MultiSafepay does not store your data longer than permitted by legal retention periods. Through MultiSafepay, you can use various payment methods, including PayPal.

Stripe

For credit card and other payments, we also use Stripe. Stripe securely processes your payment details and has implemented extensive security measures to protect your personal data and payment information. Stripe is certified according to the highest security standards (PCI DSS Level 1). Stripe stores your data solely for the execution of payments and complies with all applicable privacy laws.

Reviews

Webwinkelkeur

For collecting and displaying customer reviews, we use the services of Webwinkelkeur. Webwinkelkeur sends invitations on our behalf to customers who have placed an order with us to leave a review. We do not store any personal data from these reviews ourselves. All personal data used for the review process is processed by Webwinkelkeur in accordance with their own privacy policy. Webwinkelkeur has taken appropriate technical and organizational measures to protect your data.

Shipping and Logistics

PostNL

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of PostNL to carry out the deliveries. For this purpose, it is necessary for us to share your name, address, and residence details with PostNL. PostNL uses this information solely for the execution of the agreement. In the event that PostNL engages subcontractors, PostNL also makes your data available to these parties.

Purpose of Data Processing

General Purpose of Processing

We use your data solely for the purpose of our services. This means that the purpose of processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time for reasons other than your request, we will explicitly ask for your permission. Your data will not be shared with third parties, except when necessary to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality by agreement with us, by oath, or by legal obligation.

Automatically Collected Data

Data automatically collected by our website is processed with the aim of further improving our services. This data (for example, your IP address, web browser, and operating system) is not considered personal data.

Cooperation with Tax and Criminal Investigations

In certain cases, Online Otaku B.V. may be legally obliged to share your data in connection with tax or criminal investigations conducted by government authorities. In such a case, we are compelled to share your data, but we will oppose this within the limits of what the law allows us.

Retention Periods

We retain your data as long as you are a client of ours. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also treat it as a request to be forgotten. Based on applicable administrative obligations, we are required to keep invoices containing your (personal) data, so we will retain this data for as long as the applicable period requires. However, employees will no longer have access to your customer profile and documents we have created in connection with your assignment.

Your Rights

Under the applicable Dutch and European legislation, you as a data subject have certain rights regarding the personal data that is processed by or on behalf of us. Below we explain what these rights are and how you can invoke them. As a rule, to prevent misuse, we only send copies or transcripts of your data to the email address already known to us. If you wish to receive the data at another email address or, for example, by post, we will ask you to provide identification. We keep a record of processed requests, and in the case of a request to be forgotten, we record anonymized data. All copies and transcripts of data are provided to you in the machine-readable format that we use within our systems. You always have the right to file a complaint with the Dutch Data Protection Authority if you suspect that we are misusing your personal data.

Right of Access

You always have the right to access the data that we (have) processed which relates to you or can be traced back to you. You can submit such a request to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send a copy of all the data to the email address known to us, along with an overview of the processors who have access to this data, specifying the category under which we have stored this data.

Right to Rectification

You always have the right to have the data that we (have) processed which relates to you or can be traced back to you, corrected. You can submit such a request to our privacy officer. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us stating that the data has been corrected.

Right to Restriction of Processing

You always have the right to restrict the processing of the data that we (have) processed which relates to you or can be traced back to you. You can submit such a request to our privacy officer. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us stating that the data will no longer be processed until you lift the restriction.

Right to Data Portability

You always have the right to have the data that we (have) processed which relates to you or can be traced back to you, transferred to another party. You can submit such a request to our privacy officer. You will then receive a response to your request within 30 days. If your request is granted, we will send transcripts or copies of all data about you that we have processed, or that has been processed on our behalf by other processors or third parties, to the email address known to us. In all likelihood, we will no longer be able to continue our services in such a case, as the secure linking of data files can then no longer be guaranteed.

Right to Object and Other Rights

In certain cases, you have the right to object to the processing of your personal data by or on behalf of Online Otaku B.V. If you object, we will immediately suspend the data processing pending the handling of your objection. If your objection is justified, we will provide you with transcripts and/or copies of the data that we (have) processed and then permanently cease processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe otherwise, please contact our privacy officer.

Google Analytics

Cookies from the American company Google are placed through our website as part of the "Analytics" service. We use this service to track and obtain reports on how visitors use the website. This processor may be required by applicable laws and regulations to provide access to this data. We have not permitted Google to use the obtained analytics information for other Google services.
